| dcterms.abstract | Construction work is implemented with many events happening within one timeframe and two events or more could experience concurrent delays. Literature reveals that there is no consensus as to how concurrent delays should be treated across different jurisdictions. The adoption or otherwise of the three approaches, namely dominant cause, Malmaison approach and apportionment have attracted much discussion whereas little attention has been paid to the views of the construction industry. This dissertation aims at seeking improvement in practice by collecting the views of the construction industry in Hong Kong as to which approach should be adopted in dealing with construction delays, and other way(s) of treatment of construction delays. In pursuit of the subject research aim, the research method adopted was by way of interview with the construction professionals in Hong Kong. The findings revealed that the present position in Hong Kong is unsatisfactory that without judicial precedent, it remains unclear as to which approach of dealing with concurrent delay should be adopted and further that whereas it was proper for parties to the construction contract to have a concurrency clause inserted in the contract, the possibility of an addition of a standard concurrency clause in the Standard Form, which may be a controversial issue for one reason or another, together with other alternatives, may be further explored for the benefit of the construction industry in Hong Kong. | en_US |
