| dcterms.abstract | 在国际品牌酒店日益进入中国大陆市场的背景下，如何防范国际品牌酒店在中国大陆经营过程中可能遇到的法律纠纷，已经成为一个具有实践意义的议题。目前，国际品牌酒店进入中国大陆的主要法律纠纷可以分为五大类型，即酒店与业主方的纠纷、酒店与客户的纠纷、酒店与合作方的纠纷、酒店与竞争对手的纠纷、酒店与员工的纠纷。本研究主要通过案例研究法、访谈法和问卷调查法进行研究，案例研究法将选取公开数据中具有典型意义的诉讼纠纷，对每一类型选取一个具有代表性的案例进行单案例研究，同时对国际品牌酒店自2013 年以来在中国大陆发生的所有案例进行多案例分析；访谈法主要通过对国际品牌酒店的高管和酒店业协会进行询问和发放调查问卷的方式进行；问卷调查法主要通过对国际品牌酒店的法务部门工作人员/高管发放调查问卷的方式进行。本研究对国际品牌酒店在中国大陆的五大纠纷类型进行了进一步分类，并针对每一类纠纷分别提出了一对一的具有实用性的纠纷解决策略；同时，在对单个类型纠纷分析的基础上，本研究构建了国际品牌酒店在中国大陆地区的风险防范联动机制，包括完善酒店内部治理结构，组建专业的法律事务部门和管控体系，建立健全风险应急处置小组和联动预警机制，加强风险储备基金的运作和支持等。 | en_US |
