dcterms.abstract在全球化和技术快速迭代的背景下,非专利实施主体(Non-Practicing Entities, NPEs)的复杂角色日益引发争议。传统研究多将 NPEs 视为 “专利流氓”,强调其通过诉讼威胁和高昂和解费用抑制企业创新的负面影响。然而,本研究通过实证分析,揭示了 NPEs 在专利市场中的双重作用,它们既能加剧利益冲突,也能通过竞争压力、知识溢出和市场信号传递形成创新激励机制。en_US
dcterms.abstract本研究利用美国专利商标局(USPTO)和斯坦福大学 NPE 诉讼数据库的专利与诉讼数据,采用动态面板模型和固定效应泊松回归方法,实证检验了 NPEs 专利诉讼活动对企业创新的多维影响。核心发现如下:(1)创新产出提升:NPEs 的诉讼压力显著促进被诉企业同行公司的创新活动,诉讼强度每增加 1 个标准差,同行企业专利申请量增长 5%。(2)专利质量优化:诉讼通过技术筛选与知识溢出机制,推动同行企业专利价值提升 12%-18%,专利引用影响力增加 24.8%,且技术原创性与跨领域应用潜力显著改善。(3)长期效应与异质性:NPEs 诉讼促使企业调整研发策略,三年累计专利产出增长 27%,但效应受企业财务约束和行业竞争强度调节——财务约束强、技术竞争激烈的企业响应更显著。(4)政策干预的双重性:基于美国州级反 NPE 法案的交错双重差分(Staggered DiD)分析表明,政策虽短期释放被诉企业创新活力(三年专利增长 27%),但削弱了 NPEs 对同行企业的信号传递功能,导致其创新效率下降(标准化专利量减少 32%)。并且考虑到被诉企业的数量较少(3123 家),而被诉企业同行公司的数量较多(20874 家),业界不应忽视这种 NPEs 活动带来的正面效应。en_US
